The work
Pages describing audits, reviews, workshops, and monthly notes are invitations to commission professional services. They are not an offer of software, hosting, advertising, or employment. A contract exists only when we send a one-page scope, you accept it, and any stated deposit is paid.
Your responsibilities
You must have the authority to grant us access to the app, exports, and staff conversations named in the scope. You must not ask us to misstate figures for a sales meeting or a public claim. You remain responsible for editorial decisions taken after a briefing.
Intellectual property
The written briefing, tables, and crib sheets we prepare for you are licensed to the commissioning title for internal newsroom use, including morning conference and board papers. They may not be resold, published as a Toolkitgarden endorsement, or used to train another consultancy without written consent. Our method descriptions on this website remain ours.
Website licence
You may read and share links to this website for ordinary professional purposes. You may not scrape it, copy its text as your own, or frame it. All site copy, layout, and marks are reserved unless a law of Malaysia says otherwise.
Liability
Briefings are professional opinions based on the week, access, and exports you provide. They are not guarantees of subscriber numbers, alert performance, or commercial outcomes. To the extent permitted by Malaysian law, our liability for a commissioned piece of work is limited to the fees paid for that piece. We are not liable for lost advertising, lost print sales, or reputational harm arising from decisions you take after a briefing. Nothing in these terms limits liability for fraud or for death or personal injury caused by negligence where such a limit would be unlawful.
Acceptable use of the site
Do not misuse the contact form, attempt to disrupt the site, or send unlawful content. We may refuse or end work if access was granted under false pretences.
Governing law
These terms, and any dispute about the site or a commissioned briefing, are governed by the laws of Malaysia. Courts of Malaysia have exclusive jurisdiction, without prejudice to any non-waivable consumer right you may have.
Changes
